KENTER SCHOOL GUNMAN SENTENCED

At today’s Criminal Court proceedings, Mr. Lynford Wiley was sentenced (in a plea bargain that PSG supports and approved) to felony probation for five years. During his probation, he is out of the neighborhood (he moved out of his house last weekend).

During the 5-year probation, he cannot come within 500 yards of the Kenter Canyon School, which means that he cannot live in or visit the house he owns at 570 N. Kenter Avenue. Please note that Mr. Wiley’s wife is allowed to live in and visit the house, even thought he cannot do either. Also, please note that, as part of the Wileys’ continuing efforts (which are encouraged by PSG) to sell or lease the house, repairmen, realtors, contractors, and prospective sellers/tenants will be at the house.

In addition to the Order preventing Mr. Wiley from approaching the School or visiting the house, his sentence includes:

30 days Cal Trans service
Three-times a week AA attendance for the 5-year length of the probation
No use, possession or threatening to use weapons
The weapons removed from his house will be destroyed
He is subject to search of his person and premises by his probation officer or any law enforcement officer at any time
He may not drink or be present in places where the primary purpose is to sell alcohol (for example, taverns)
He must keep his probation officer informed at all times of his residence and meet with him/her regularly

Separate from the criminal proceedings, PSG has filed a civil lawsuit against Mr. Wiley seeking compensation for the damages he caused and a civil injunction to help ensure no further trouble from him. The primary goals of the civil suit are to: (1) ensure that Mr. Wiley stays away from the School and sells or leases the house [a remedy that cannot be ordered in the criminal proceedings], (2) allow us to obtain information concerning Mr. Wiley and monitor his activities directly, without the need of going through the criminal justice/probation system, and (3) possibly obtain restitution for the damages he caused and the money we spent. Zack Rozio and I have volunteered to represent the PSG without charge in this lawsuit, which is Los Angeles County Superior Court Case No. SC102305, before

Judge Lisa Hart Cole in Dept. X of the Beverly Hills Courthouse. Mr. Wiley has until May 4 to respond to the Complaint and until May 21 to respond to our initial discovery demands (requests that he answer questions in writing and produce various categories of documents).
