Gambling Regulations in California

California has the potential to be a powerhouse in online gambling, but the state is still a long way from realizing that promise. The nation’s most populous state is home to a diverse array of Native American tribal casinos and poker rooms. However, no legal real-money online casino gambling, online poker, or sports betting services are offered in California. 

In recent years, state officials have offered measures to legalize and regulate various online casino games, but none have gained momentum. Yes, there are several types of gambling that are permitted in California. The California Constitution prohibits some sorts of gambling but includes a list of exceptions.

What Types of Gambling are Considered Illegal?

Banking, mobile gambling, and percentage games in California are outlawed. California sports betting (excluding horse racing betting) is also banned. The list of forbidden acts isn’t exhaustive. The games listed below are some of the games forbidden, but there are more. 

  • Faro
  • Roulette
  • Monte
  • Lansquenet
  • Rondo
  • Rouge et Noir
  • Tan
  • Fan-Tan
  • Twenty-One
  • Seven-and-a-half
  • Hokey-pokey

What Types of Gambling Are Legal?

There are no internet gambling regulations under California law, and users can play any game they wish (online poker, blackjack, and any other, even prohibited, games). It may also be profitable because casino websites offer the finest online casino payouts. The need for online casino regulation is obvious nowadays.

There are several exceptions to gaming laws: card rooms, tribal casinos, the California state lottery, charitable bingo games and raffles, and horse racing betting are all legal. Casinos operated by Native American tribes on Indian property are permitted to provide card games and slots. 

The federal Indian Gaming Regulatory Act requires each tribe to hold a license for such activities. In addition, safe and well-known payment options such as Visa and Mastercard are available. Charitable gambling entails spending the winnings on any type of charity. 

Charity groups frequently host such events. The California lottery is a state-sponsored activity. Players should note that the legal gambling age in California is 21. However, for native American tribes’ casinos, it can be 18.

When Will All Types of Gambling Be Legal?

It’s difficult to see internet gambling legislation passing anytime soon for various reasons. Tribal casinos, poker room owners, and state politicians have very different interests and agendas, making it impossible to reach an agreement. Any measure would require the approval of two-thirds of the State Legislature and public support in a referendum.

However, the picture for online sports betting is more promising than for online casino regulations. After the 2018 U.S. Supreme Court ruling permitting states to legalize sports betting, online sports betting has grown more widespread. California politicians are concerned about losing potential sports wagering tax income to neighbouring states.

A Political Impasse

California gaming provides an odd contrast between some of the most widespread gambling infrastructures and some of the most strict restrictions. Gambling dates back to the state’s founding in the mid-19th century. During the Gold Rush era, gambling became a part of the everyday lives of pioneers. 

That part of history has persisted despite drastic transformations in gambling views in California and the country as a whole. The growth of card rooms best represents California’s gaming history. Even having an anti-gambling language in its constitution, card rooms and horse racing has thrived despite the prohibition of most other types of gambling. This started to shift in the late 1980s.

The federal government expanded the ability of Native American tribes on any recognized sovereign property to provide casino games. In the ensuing decades, more than half of the 100 federally recognized tribes initiated casino gambling, resulting in a large new gaming infrastructure that’s not subject to California’s constitutional limits. 

The long-established horse racing and card rooms are now competing for California’s gambling future with Native American gaming establishments. This has contributed to the political impasse.
