Gambling Laws in California: Is Gaming Legal?

California has a long history with gambling, both legal and illegal, as a frontier state. California became one of the most powerful states in America as a result of its population growth over the 20th century. California has some of the most lenient gambling laws in the nation, outside of Nevada and New Jersey. Californian gaming events frequently spark national debates. The fact that the state is moving closer to the complete legalization of gambling is, therefore, excellent news for gamblers. But where are we exactly on the path to legalization? What are the key events of the past that influence the current wave of support for legalization?

A Brief Timeline of California’s Gambling Legalization

Gambling has been a difficult topic in California for many years. Both proponents and opponents of gambling legalization can be found in bulk throughout the history of California. Due to California’s extensive Native American history, casinos have only been permitted to be built there. Additionally, tribal gaming promoted tourism, lowered unemployment, and safeguarded the independence of native tribes. Native American tribes were reported to be running 63 casinos in 2019 that brought in an estimated $6 billion annually.

Legislation permitting the development of gambling businesses was ultimately approved in 1984 when it became apparent that there would continue to be a demand for gaming in California. Of course, these enterprises were subject to very tight regulations and laws. They consist of activities like cardrooms, wagering on horse races, charitable organizations (i.e., raffles), and the state lottery. Each year, these games contribute billions to California’s economy. 

As for online gambling – it is technically legal, but no one can operate an online casino with actual money involved in California. A proposal to regulate internet poker was presented to the California Senate in 2012, but it was rejected. In 2014, more people attempted to do the same, but they were rejected as well.

What Games Are Legal in California?

So, what’s legal and illegal to play in the state of California? Let’s find out.

When it comes to card games, poker, and blackjack are legal, but only when they are played in legalized cardrooms regulated by the government.

As for slot machines – they are illegal, but, there is an exception, you can play antique slot machines that are older than 25 years. But even then, they cannot be used for real money gambling.

What about sports betting? It is technically legal, but one cannot start bookmaking or accept bets. Online sports betting is illegal.

The lottery is technically legal, but they are not used for net revenue, but rather for generating money for the government. The same goes for bingo games, they can only be arranged by tribal casinos or charitable organizations.

Social gambling is absolutely illegal.

Draw poker is legal as long as the population of a county doesn’t exceed 4 million citizens.

Technically, online gaming is illegal in California, but it’s possible to participate in online gambling on foreign licensed websites.
